Terms of Service

Please read these Terms of Service carefully before using ShiftMap. By using the service, you agree to be bound by these terms. If you do not agree, do not use ShiftMap.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and ShiftMap ("ShiftMap," "we," "us," or "our") governing your access to and use of the ShiftMap website and services (collectively, the "Service"). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of a business, you represent and warrant that you have authority to bind that business to these Terms.

2. What ShiftMap Is

ShiftMap is a job listing and discovery platform for the service industry in the United States. ShiftMap connects jobseekers with employers by publishing job listings submitted by employers or sourced from publicly available information.

Important: ShiftMap is a neutral listing platform only. We are not an employer, staffing agency, or employment agency. We are not a party to any employment relationship, offer of employment, or application process between a jobseeker and an employer. ShiftMap makes no representations and assumes no responsibility regarding any employment relationship that may arise from use of the Service.

3. Eligibility

You must be at least 18 years of age to create an employer account or post a job listing. By creating an account, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

Jobseekers may browse listings without creating an account and are not subject to an age requirement from ShiftMap. Employers are solely responsible for verifying the eligibility and qualifications of applicants, including any age requirements applicable to the position being filled.

4. Employer Accounts

Account Registration

To post job listings, employers must create an account using a valid email address and password. You agree to provide accurate and complete information and to keep your account information current. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Notify us immediately at support@shiftmap.app if you believe your account has been compromised.

Two-Factor Authentication

Two-factor authentication is mandatory for all employer accounts. A grace period of seven days from account creation is provided before two-factor authentication is required. After the grace period, you must complete two-factor authentication setup before accessing the employer dashboard or posting a job. Failure to complete setup will result in restricted access until two-factor authentication is enabled. This requirement exists to protect your account and the integrity of the platform.

Account Responsibilities

You are solely responsible for all content you submit through your account, including job listing details, contact information, and application instructions. You agree that all information you provide is accurate, lawful, and does not mislead jobseekers.

Automated Content Screening

All submitted listings are subject to automated content screening before review. This process checks listing content against prohibited terms and patterns using server-side keyword analysis. Listings that trigger a flag are held for manual review. Listings that pass screening proceed to manual review automatically. Screening does not involve any third-party AI service and your listing content is not shared with any external party for this purpose.

Listing Moderation

All paid listings are reviewed by ShiftMap before they are made publicly visible. Payment does not guarantee publication. ShiftMap reserves the right to reject any listing that violates these Terms or is otherwise determined to be inappropriate for the platform. Listings are typically reviewed within one business day of payment. You will be notified of the outcome by email.

Listing Duration and Removal

Listing durations are determined by the post type purchased — fourteen days for a Two Week Post and thirty days for a One Month Post — beginning from the date the listing is approved and made publicly visible. ShiftMap reserves the right to remove any published listing at any time, without notice or refund, if we determine in our sole discretion that the listing violates these Terms or is otherwise inappropriate for the platform.

6. Publicly Sourced Listings

Some listings on ShiftMap are sourced from publicly available information on the internet rather than submitted directly by employers. These listings are clearly labeled "Publicly sourced."

ShiftMap makes no representations about the accuracy, completeness, or timeliness of publicly sourced listings. Pay rates, contact information, application instructions, and other details in publicly sourced listings may be inaccurate or out of date. ShiftMap is not responsible for errors in publicly sourced listing content and disclaims all liability arising from reliance on such content.

Employers may claim a publicly sourced listing through their employer account. By claiming a listing, the employer assumes responsibility for the accuracy of that listing's content going forward.

If you are an employer and believe a publicly sourced listing about your business is inaccurate or should be removed, contact us at listings@shiftmap.app.

7. Fees and Payment

Job Posting Fees

Posting a job listing on ShiftMap requires payment of the applicable fee as described on our pricing page. All fees are stated in US dollars and are charged at the time of purchase. Payment does not guarantee that a listing will be published. All listings are subject to review as described in Section 5.

Payment Processing

All payments are processed by Stripe, Inc., a third-party payment processor. By making a payment, you agree to Stripe's terms of service and privacy policy. ShiftMap does not store your payment card information. ShiftMap is not liable for errors, failures, or security incidents related to Stripe's payment processing services.

Refund Policy

Job posting fees are non-refundable once a listing has been published and made publicly visible.

If your listing is rejected before publication for a violation of these Terms, no refund will be issued. If your listing is rejected before publication for reasons unrelated to a Terms violation — such as a confirmed automated screening false positive or a technical error on our part — you may submit a refund request to support@shiftmap.app within 7 days of receiving the rejection notice. Refund requests are reviewed at ShiftMap's sole discretion. ShiftMap will apply this policy consistently and document the basis for each decision.

If a published listing is removed by ShiftMap for violation of these Terms, no refund will be issued for unused listing time.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SHIFTMAP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ShiftMap does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. ShiftMap does not warrant the accuracy, completeness, or usefulness of any information on the Service, including job listings submitted by employers or sourced from third parties.

ShiftMap makes no warranty and assumes no responsibility with respect to any employment relationship, offer of employment, working conditions, compensation, or workplace safety that may arise from use of the Service.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SHIFTMAP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL SHIFTMAP'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO SHIFTMAP IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In those jurisdictions, the above limitations apply to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless ShiftMap and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) any job listing you submit; (c) your violation of these Terms; (d) your violation of any applicable law or the rights of any third party; or (e) any employment relationship or dispute arising from a listing on the Service.

12. Third-Party Services

The Service integrates with or links to third-party services including payment processing services, employer career portals, and external job boards. ShiftMap is not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is governed by those services' own terms and policies.

13. Intellectual Property

The ShiftMap name, logo, website design, and original content (excluding employer-submitted listings) are owned by ShiftMap and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from ShiftMap's proprietary content without our prior written consent.

By submitting a job listing, you grant ShiftMap a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute the listing content on the Service and in related marketing materials (such as email roundups and social media posts) for the duration of the listing and for a reasonable period after its expiration.

14. Termination

ShiftMap may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. You may close your account at any time by contacting us at support@shiftmap.app.

If ShiftMap terminates your account for violation of these Terms, any active listings will be removed immediately and no refund will be issued for unused listing time.

Upon termination, your right to use the Service ceases immediately. Sections 9, 10, 11, 13, and 16 of these Terms survive termination.

15. Geographic Scope

ShiftMap is intended for use in the United States. We do not knowingly provide services to individuals or businesses located in the European Union. If you are located in the EU please do not use this Service.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction in those courts.

17. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will update the effective date at the top of this page. If we make material changes, we will notify employer account holders by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

18. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and ShiftMap with respect to the Service and supersede all prior agreements, representations, and understandings.
